1. Eligibility Requirements

a. Open to Legal Residents:

• This giveaway is open only to legal residents of the United States and Canada, excluding Quebec. Participants must be 18 years or older at the time of entry.

b. Exclusions:

• Residents of Quebec, Canada, are excluded from participating in this giveaway due to local regulations.    - Employees of PUMP Basketball & Players Unlimited and their immediate family members (spouse, parents, siblings, and children) are NOT eligible to participate.

2. Prize Details

a. Prize Description:

• The winner will receive an NBA ticket or two (2), or a WNBA ticket or two (2), as long as the retail value (RV) does not exceed $299. After claiming their prize, the winner has 7 days to request their preference(s) in tickets with full communication with the sponsor. The sponsor will select the tickets but will make every effort to accommodate the winner’s preferences. If the requested ticket(s) are unavailable, the sponsor reserves the right to select similar tickets within the value range of $299.

b. Prize Delivery:

• The winner will receive their NBA/WNBA tickets through a secure digital transfer via platforms such as Ticketmaster, StubHub, SeatGeek, Vivid Seats, AXS, Gametime, or the official team app/website. The winner must have access to the required platform or app to receive and use the digital tickets. All transfers will be documented for confirmation, and the winner may be required to sign an acknowledgment of receipt.

3. Entry Method

a. How to Enter:

• Participants must subscribe to the PUMP Basketball & Players Unlimited newsletter, read the daily newsletter, and complete the quiz provided each day to enter.

b. Free Entry:

• Entry into the giveaway is free, requiring only the completion of the daily quiz after subscribing to the newsletter.

c. Recurring Monthly Giveaway:

• These Official Rules apply to the PUMP Basketball & Players Unlimited NBA/WNBA Ticket(s) Giveaway, which will be conducted on a monthly basis. Each giveaway period will begin on the 1st day of the month and end on the last day of the month. Participants who enter in any given month will be eligible for automatic entry in subsequent months unless they choose to opt out. To remain eligible, participants must confirm their participation at the beginning of each month by continuing to complete the daily quizzes.

4. Winner Selection

a. Selection Process:

• The winner will be determined based on the highest cumulative score from all quizzes completed during the giveaway period.

b. Tie-Breaker:

• In the event of a tie, the winner will be determined by the shortest cumulative time taken to complete each quiz from when the newsletter is sent out.

c. Notification:

• The winner will be notified via email within 7 days of the giveaway end date. The winner must respond within 7 days of notification to claim the prize. If the winner does not meet all qualifications or gets disqualified, the prize won't go to anyone for that month.

d. Recurring Winners:

• Participants are eligible to win in multiple monthly giveaway periods, but no participant may win more than once in a 12-month period.

e. Disqualification and Re-entry Ban:

• Any participant who is disqualified due to cheating, fraud, or failure to comply with the official rules will be permanently barred from entering this or any future PUMP Basketball & Players Unlimited giveaways. The sponsor reserves the right to monitor for such behavior and enforce this ban across all future giveaway periods.

5. Official Rules & Disclaimers

a. Entry Limitations:

• Single Entry: Each participant is limited to one entry per person. Multiple entries by the same individual through different accounts, email addresses, or identities are strictly prohibited and will result in disqualification.

b. Identity Verification:

• The sponsor reserves the right to verify the identity of participants at any stage of the giveaway. This may include requiring the winner to provide government-issued identification or other forms of proof to confirm that the name on the entry matches the name on the provided identification. Failure to provide such proof within 48 hours after claiming the prize will result in disqualification, and the prize will be awarded to the next highest-placed individual.

c. Fraud Prevention:

• Disqualification for Fraud: Any attempt to manipulate or undermine the legitimate operation of the giveaway, including but not limited to creating multiple accounts, using automated entry methods, or sharing quiz answers, will result in disqualification.
• IP Address Monitoring: Entries may be monitored for IP address activity. Multiple entries from the same IP address may be disqualified unless justified by legitimate circumstances, such as family members participating from the same household.
• Unique Contact Information: Participants must enter using a unique, valid email address and contact information. Duplicate entries with the same contact information will be disqualified.

d. Participant Release:

• Release of Liability: By participating in this giveaway, you ("Participant") agree to release, discharge, and hold harmless PUMP Basketball & Players Unlimited, its subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors (collectively, "Released Parties") from any and all liability, claims, or causes of action of any kind that may arise out of or in connection with your participation in the giveaway, including but not limited to (i) unauthorized human intervention in the giveaway; (ii) technical errors related to computers, servers, providers, or telephone or network lines; (iii) printing errors; (iv) late, lost, misdirected, or undeliverable mail; (v) errors in the administration of the giveaway or the processing of entries; or (vi) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the giveaway or receipt or use or misuse of any prize.
• Social Media Platform Release: This giveaway is in no way sponsored, endorsed, administered by, or associated with any social media platform, including but not limited to Facebook, Instagram, YouTube, TikTok, and X (formerly Twitter). By participating, you agree to release and hold harmless each social media platform from any and all liability associated with this giveaway.
• NBA/WNBA Release: This giveaway is not sponsored, endorsed, administered by, or associated with the NBA, the WNBA, or any of their affiliates. By participating, you agree to release and hold harmless the NBA, the WNBA, and their respective affiliates from any and all liability arising from your participation in the giveaway or the acceptance, possession, use, or misuse of any prize.
• Publicity Release: Except where prohibited by law, participation in the giveaway constitutes the Participant’s consent to the Released Parties’ use of the Participant’s name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
• Acknowledgment: By entering this giveaway, you acknowledge that you have read and fully understood these Official Rules and the Participant Release Clause, and you agree to be bound by them. If you do not agree to these terms, you should not participate in this giveaway.

e. Final Decision:

• The sponsor's decisions on all matters related to the giveaway are final and binding. The sponsor reserves the right to disqualify any participant found to be violating these rules.

f. Permanent Ban for Rule Violations:

• Participants found to be in violation of these rules, including those disqualified for cheating or fraud, will not be permitted to re-enter this or any future PUMP Basketball & Players Unlimited giveaways. The sponsor will maintain a list of disqualified participants and will enforce this ban to protect the integrity of the giveaway.

g. Limitation of Liability:

• In no event shall PUMP Basketball & Players Unlimited, its subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the giveaway, regardless of whether such damages were foreseeable or whether the sponsor has been advised of the possibility of such damages.

h. User Conduct:

• Participants are expected to conduct themselves in a respectful and lawful manner during the giveaway. Any disruptive, abusive, or illegal behavior may result in immediate disqualification from the giveaway at the sole discretion of PUMP Basketball & Players Unlimited. This includes, but is not limited to, harassment of other participants, spamming, or attempting to manipulate the giveaway process.

i. Right to Disqualify:

• In addition to the reasons stated above, PUMP Basketball & Players Unlimited reserves the right to disqualify any participant at its sole discretion for any reason, including but not limited to suspicion of illegal activity, violation of these terms, or any behavior that compromises the integrity of the giveaway.

j. Disclaimer of Warranties:

• The sponsor makes no representations or warranties of any kind, express or implied, regarding the giveaway or any prize awarded. Prizes are provided 'as is' without any warranty, guarantee, or representation of any kind.

k. Indemnification:

• By participating in this giveaway, you agree to indemnify, defend, and hold harmless PUMP Basketball & Players Unlimited, its subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your participation in the giveaway, violation of these Official Rules, or violation of any third-party rights, including intellectual property, publicity, or privacy rights.

l. Arbitration Clause:

• Any disputes arising out of or related to this giveaway or these Official Rules will be resolved exclusively through binding arbitration, and not in a court of law. The arbitration shall be conducted in Atlanta, Georgia, and governed by the laws of Georgia. Each party shall bear its own costs and fees associated with arbitration unless the arbitrator determines otherwise.

m. Force Majeure Clause:

• The sponsor shall not be liable or responsible for any failure or delay in the execution of the giveaway or fulfillment of any prize due to circumstances beyond its reasonable control, including but not limited to acts of God, war, government restrictions, natural disasters, pandemics, or failure of any social media platform, internet service provider, or telecommunications network.

n. Governing Law and Jurisdiction:

• This giveaway and these Official Rules are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. Any legal actions, suits, or proceedings arising out of or relating to this giveaway shall be brought exclusively in the federal or state courts located in Atlanta, Georgia, and each participant consents to the exclusive jurisdiction of such courts for the resolution of any disputes.

o. Compliance with Laws:

• Participants agree to comply with all applicable federal, state, and local laws, regulations, and ordinances related to the giveaway. Any attempt by a participant to deliberately damage or undermine the legitimate operation of the giveaway may be in violation of criminal and civil laws, and should such an attempt be made, PUMP Basketball & Players Unlimited reserves the right to seek damages from any such participant to the fullest extent permitted by law.

p. No Waiver:

• The failure of PUMP Basketball & Players Unlimited to enforce any provision of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules.

q. Entire Agreement:

• These Official Rules constitute the entire agreement between the participants and PUMP Basketball & Players Unlimited concerning the giveaway and supersede all previous agreements, representations, and understandings, whether written or oral, relating to the giveaway.

r. Participant Consent:

• By participating in the giveaway, participants agree to be fully unconditionally bound by these Official Rules, and they represent and warrant that they meet the eligibility requirements. In addition, participants agree to accept the decisions of PUMP Basketball & Players Unlimited as final and binding as it relates to the content of this giveaway.

s. Intellectual Property:

• All promotional materials, trademarks, logos, and other intellectual property used in connection with the giveaway are the property of PUMP Basketball & Players Unlimited or its affiliates and are protected by law. Unauthorized use is strictly prohibited.

t. Sponsor and Partner Liability:

• PUMP Basketball & Players Unlimited and any partners or sponsors involved in the giveaway, including employees of PUMP Basketball & Players Unlimited, are not liable for any issues, claims, or disputes that arise in connection with the giveaway. By participating, you agree to release and hold harmless PUMP Basketball & Players Unlimited, its employees, partners, sponsors, and affiliates from any liability related to the giveaway.

u. Modification of Rules:

• Right to Modify: PUMP Basketball & Players Unlimited reserves the right to modify, alter, or update these Official Rules at any time without prior notice. Such modifications will take effect immediately upon being posted on the giveaway landing page. Continued participation in the giveaway after any such changes shall constitute your consent to such changes.

6. Skill-Testing Question (Canada)

a. Canadian Compliance:

• In compliance with Canadian law, if the selected winner is a resident of Canada, they must correctly answer a skill-testing question to claim their prize.

8. Tax Implications

a. U.S. Tax Reporting:

• The winner of the giveaway is responsible for any applicable federal, state, and local taxes associated with the receipt of the prize. For U.S. winners, a Form 1099-MISC may be required to be filed with the IRS if the prize retail value exceeds $600. This clause is included for completeness, even though the prize retail value is capped at $299, ensuring you are covered in case of any changes or misunderstandings.

b. Canadian Tax Implications:

• In Canada, prizes from giveaways are generally not subject to taxes. However, winners are advised to consult with a tax professional to understand any potential tax obligations based on their personal circumstances. PUMP Basketball & Players Unlimited will not be responsible for any taxes that may arise from winning the prize.

c. Tax Reporting Obligations (U.S. and Canada):

• In the event that the winner is a resident of Canada and the prize requires reporting to the IRS or Canadian tax authorities, the winner will be responsible for any applicable taxes, duties, or fees associated with the prize. 9. Platform-Specific Guidelines

a. Social Media Compliance:

• This giveaway may be promoted on social media platforms including YouTube, Facebook, Twitter, Instagram, and TikTok. However, this giveaway is not sponsored, endorsed, administered by, or associated with any of these platforms.
• The promotion of the giveaway will comply with each platform's specific guidelines for giveaways and promotions.

10. Exclusion of Quebec

a. Regional Exclusion:

• Due to differing contest regulations, residents of Quebec are not eligible to participate in this giveaway. This exclusion is clearly stated in the eligibility section of the official rules.

11. Winner Notification and Prize Fulfillment

a. Notification Process:

• The winner will be notified via email and must respond within 7 days to claim their prize. If the winner does not respond within the specified time, an alternate winner may be selected at the sponsor’s discretion.

b. Prize Delivery:

• The prize will be delivered digitally through a secure platform. The winner must have access to the necessary platform or app to receive and use the tickets.

12. Miscellaneous

a. Void Where Prohibited:

• This giveaway is void where prohibited by law.

b. Final Decision Authority:

• The sponsor reserves the sole right to interpret and apply these official rules. All decisions made by the sponsor regarding any aspect of the giveaway, including but not limited to eligibility, rule interpretation, and prize distribution, are final and binding.

c. Dispute Resolution:

• Any disputes or questions regarding the giveaway or these official rules will be resolved at the sole discretion of the sponsor. Participants agree to abide by the decisions made by the sponsor.

e. No Appeal:

• Once a decision has been made by the sponsor, it is final. There will be no appeal or reconsideration of the decision.

• Resumption of Giveaway: If the giveaway is suspended or modified due to technical issues, the sponsor will make reasonable efforts to resume the giveaway in a manner that is fair to all participants, including extending the giveaway period if necessary.
• Entry Confirmation: It is the responsibility of the participant to ensure that their entry has been successfully submitted. The sponsor is not liable for any entries that are lost, incomplete, delayed, or otherwise compromised due to technical issues.
• Winner Notification: In the event that technical issues prevent the sponsor from notifying the winner, the sponsor will make reasonable efforts to contact the winner through alternative means.

13. Expected Giveaway Start Date

a. Start Date:

• The first giveaway under these Official Rules is expected to begin on February 1st, 2025. This date is subject to change at the discretion of PUMP Basketball & Players Unlimited.

b. Notification of Changes:

• If the start date changes, PUMP Basketball & Players Unlimited will notify participants via email and update the giveaway landing page with the new start date.

14. Continuation on Mailing List

a. Mailing List:  

• Participants who do not win or choose not to participate in future giveaways will remain on the PUMP Basketball & Players Unlimited mailing list unless they opt out. Participants can opt-out of the mailing list at any time by following the unsubscribe instructions provided in the email communications.

15. Prize Conditions

a. Prize Acceptance:

• By accepting this prize, the winner agrees to fulfill certain responsibilities as a condition of recieving the giveaway tickets. Specifically, the winner must record a video at the game, acknowledging Players Unlimited and expressing thanks for the tickets provided through the giveaway. This video should include a shout-out to Players Unlimited as the source of the prize and must be submitted within 48 hours after the game.

• Failure to provide this video may result in the following consequences:

Permanent Disqualification:

• The winner will be permanently disqualified from entering any future Players Unlimited giveaways or promotions.

Reimbursement Requirement:

• At Players Unlimited's discretion, the winner may be required to reimburse the full value of the tickets provided.
